LAW N. 2016-44 OF APRIL 13TH, 2016
Article 5-121-9-II of the Social Work and Family Code: “An exit-program for the social and professional assimilation of prostitutes is proposed to any person who has been a victim of prostitution, procurement, and human trafficking for the purpose of sexual exploitation. The exit-program will be structured according to evaluation of the health, professional, and social needs of the individual, in order to grant him or her to access alternatives to prostitution.”
Article 5-121-9-II of the Social Work and Family Code: “The person engaged in the exit-program for the social and profession integration of prostituted persons may be given a temporary residence permit as described in the article L. 316-1-1 of Code of Entry and Residence of Aliens and the Right to Asylum.”
Article 5-121-9-II of the Social Work and Family Code: “If the person is unable to benefit from the allocations described in the articles L. 262-2 of the present code, L. 744-9 of the Code of Entry and Residence of Aliens and the Right to Asylum and L. 5423-8 of the Labor Code, a financial aid for the social and professional integration will be given.”
Article 5-121-9-II of the Social Work and Family Code: “Any association chosen by the affected person that aids and assists persons in difficulty, in particular prostituted persons, may participate in the development and implementation of the exit-program for the social and professional integration of prostituted persons, provided that the association fulfills the conditions of certification as defined in the ordinance of the State Council.
The ordinance 2016-1467 of October, 2016 defines the exit-program for prostituted persons, the operations of the departmental commissions for the prevention and combat of prostitution, procurement and human trafficking for sexual exploitation, and the conditions of certification for the associations charged with the implementation of the exit-program for prostituted persons.
CONCERNING THE ACCREDITATION OF ASSOCIATIONS:
Article R. 121-12-1 of the Social Work and Family Code: “Associations regularly declared for at least three years, whose purpose is the aid and assistance of persons involved in prostitution, of victims of human trafficking, female victims of violence, of persons in difficulty, may be eligible for a certification, delivered by the prefect of the department in which the head office of the association is located.
Article R. 121-12-2 of the Social Work and Family Code: The certification mentioned in the article L. 121-9 is delivered to any association who, at the moment of the appeal for certification, can justify:
“1° An engagement on their part, by deliberation of a general assembly, to implement a global care program for persons involved in prostitution, victims of procurement or trafficking for sexual exploitation, of which the final objective is the discontinuation and exit from prostitution;
2° Having human and material means permitting the assurance of its mission to implement the exit-program for prostituted persons, as well as a contributing network of institutional and associative partners;
3° The establishment of training programs for the employees and volunteers, having the objective of assisting prostituted persons within the implementation of a social and professional integration project, and permitting these persons to access alternatives to prostitution.”
